1. Scope

These general conditions come into force on February 12, 2019 and apply to all training offers offered on the Vertical Master website.

2. Order and Conclusion of the Contract

By clicking on the “order” button, the customer makes a binding offer for the selected training course. The validation of the order by the customer also constitutes acceptance of these general conditions. The contract is deemed concluded upon receipt of the order confirmation sent by Vertical Master to the customer.

3. Price

All prices of Vertical Master are indicated in Swiss francs (CHF). The prices indicated are valid only within the territory of Switzerland. Vertical Master reserves the right to modify its prices at any time. For the customer, only the price indicated in the order confirmation shall be binding.

4. Payment

The payment methods accepted by Vertical Master are exclusively those indicated on the website. The risk of any malfunction of the payment system is borne by the customer, with full release of liability for Vertical Master.

5. Registration for a Training

Registration for a training course can only be carried out via the Vertical Master website. Proof of registration is the order confirmation issued by Vertical Master.

6. Exemption

A request for exemption from a training course may only be accepted by Vertical Master if it is received by email or by post at least two weeks before the start of the training. A request received less than two weeks before the start of the training will only be accepted upon presentation of a medical certificate. The customer may then register, free of charge, for an identical training course on the dates available on the website within six months of the missed training. The customer is not entitled to request a refund for the training.

7. Cancellation

Vertical Master reserves the right to cancel a training course if weather or atmospheric conditions do not allow safe operation of a drone. Likewise, Vertical Master may cancel a training course if an instructor is ill and no replacement with equivalent skills can be found before the start of the training. In the event of cancellation by Vertical Master, the customer may freely and free of charge choose an alternative training date from those available on the website within six months of the cancelled training. The customer is not entitled to request a refund.

8. Number of Participants

In order to ensure the smooth running of training courses, Vertical Master sets a minimum and maximum number of participants for each course. Places are allocated in the order in which registrations are received. If the number of participants is insufficient, Vertical Master reserves the right to cancel the training. In this case, the customer may freely and free of charge choose a new date or request a refund for the training.

9. Civil Liability Insurance

If the customer wishes to use their personal drone during a training course, they must ensure in advance that they have taken out third-party liability insurance covering the use of the drone.

10. Partial Invalidity

If one or more provisions of these general conditions are found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions. Any invalid provision shall be replaced by a valid provision whose economic purpose comes as close as possible to that of the invalid provision. The same shall apply in the event of a contractual gap.

11. Applicable Law

These general conditions and any disputes or claims arising out of or in connection with them, including disputes or claims of a non-contractual nature, shall be governed exclusively by Swiss law.

12. Place of Jurisdiction

Any dispute relating to the conclusion, interpretation, performance or termination of these general conditions shall be subject to the exclusive jurisdiction of the courts of Payerne.
